Description:

Development of the concept and definition of international law: classifications of international law; the legal nature of international law; the relationship between international and internal law. Historical development of international law: antiquity; middle ages; early modern period; contemporary period. Development of international legal doctrine: antiquity; middle ages; early modern period; contemporary period. Recent tendencies in the development of international law.

Cognitive Skills:

Knowledge and understanding

After successfully completing the course, students will be able to:

- identify theories about the development and fragmentation of international law;

- define legal terms connected with the development of international law;

- explain trends in the development of international law and recognise their connection and integration in the international law system.

 

Application

After successfully completing the course, students will be able to:

- group and describe factors and and circumstances that affect the development of international law;

- apply relevant international law norms to concrete examples from international practice;

- illustrate the importance of international law for the stability of international order and strengthening of cooperation among the states and other international law subjects.

 

Analysis

After successfully completing the course, students will be able to:

- analyse processes of the origin of international law;

- distinguish forms and process of the origin of international law norms and their creators, and distinguish relevant international law institutes;

- categorise international law norms that affect the development of international community;

- examine the application of international law norms regarding various international law subjects and other participants in international relations.

 

Synthesis

After successfully completing the course, students will be able to:

- construct the connection between individual legal institutes and their integration into the overall international law system;

- formulate conclusions about the siginificance of the development of international law norms and institutes for the relations in modern world order.

 

Evaluation

After successfully completing the course, students will be able to:

- evaluate the meaning of specific international legislative processes for the stability of world order;

- judge specific roles of different international law subjects as simultanous creators and recipients of international law norms;

- assess the importance of the participation of the Republic of Croatia in the process of creation of international law on the regional European and universal level;

- evaluate the efficiency of international law norms, especially in the light of specific system of ensuring their secondary efficiency characteristic for international law.

Practical and Generic Skills:

After successful completion of the course, students will gain competences that will enable them to analyse the development of international law system through the activity of intergovernmental organisations, especially in the sense of so-called official codifications, and through the study of influence of material international law sources on the development of international law. Gained skills will enable the students to appropriately use international documents of normative content (treaties, judicial and arbitral decisions, resolutions etc.).

Matching Assessments to Learning Outcomes:

Knowledge is tested by an oral examination.

Oral examination, which is obligatory for all students, consists of testing understanding the theories about the development and fragmentation of international law, material as well as institutional, and legal concepts and institutes connected with that. Connection and comparison of legal rules and institutes is expected, as well as evaluation of the applicability of international law norms in modern international community.
