Description:

The concept of environment. Historical development of environment protection, particularly legal protection. Legal sources of environmental law: the Croatian law (the Constitution, laws, by-laws), international agreements (multilateral and bilateral), the law of European Union law and judicial practice of national and international courts. Basic principles of promotion and protection of environment. Croatian and international agencies and associations in charge of environment (authority, powers). Legal regulation of biological diversity and protection of nature, forests, land areas, waters (running and stagnant, above-ground and underground, particularly drinkable water), sea space and air (atmosphere). Legal problems of waste management. Basic forms of legal protection of environment. Basic forms of legal protection of environment: administrative law. Basic forms of legal protection of environment: civil law. Tax policy and tax measures in the sphere of preservation and protection of environment.

Cognitive Skills:

Knowledge and understanding

After successfully completing the course, students will be able to:

- explain basic principles of environment protection;

- describe constituent parts of environment and individual pressures;

- identify subjects of environment protection;

- name the documens of sustainable development and environment protection;

- explain instruments of environment protection;

- describe administrative control and inspection;

- explain ensuring the right of access to information about the environment, participation of the public in environmental issues, ensuring the rights of access to judiciary.

 

Application

After successfully completing the course, students will be able to:

- manage legal sources of environment law;

- select a mechanism of ensuring the application of rules for protection of individual components of environment and protection of environment from the influence of pressures;

- apply knowledge about legal protection of environment;

- demonstrate resons for access to information and wider participation of the public in decision-making and wider access to the judiciary in environmental issues.

 

Analysis

After successfully completing the course, students will be able to:

- distinguish different forms of legal protection of environment;

- compare legal sources of environment law;

- examine legality of public bodies acting in the area of environment protection;

- analyse the development of environment law;

- analyse problems connected with pressures for environment;

- distinguish between duties and powers of the state administration bodies, units of local and regional self-government and legal persons with public powers in the area of environment protection;

- analyse individual obligations of public authorities in ensuring the access t to information about environment, participation of the public in environmental issues and ensuring the rights of acces to the judiciary.

 

Synthesis

After successfully completing the course, students will be able to:

- propose application of legal sources of environment law in a certain case;

- anticipate what would happen is some legal norm in the area of environment law was violated;

- formulate the consequences of the violation of international legal framework;

- propose change of domestic norms in case of observed weaknesses of individual legsilative solutrions;

- foprmulate obligations of different subjects of environmental protection;

- propose preparation and/or change of documents about environmental protection and sustainable development, and other general acts for the purpose of protection of human health.

 

Evaluation

After successfully completing the course, students will be able to:

- compare different approaches to legal protection of environment;

- evaluate manner of action of competent public bodies in environmental protection;

- examine the manner of application of legal nroms related to protection of environment in a certain case;

- assess future trend of domestic environment law under the influence of European environment law;

- evaluate the quality of individual legal provisions;

- advocate the opinion about the importance of environment and the need for its legal protection;

- evaluate the relation between Environment Protection Act and other laws , by-laws and general acts that regulate protection of individual parts of environment, i.e. that regulate protection of environment from individual burdens.

Practical and Generic Skills:

After successful completion of the course students will be able to:

 

- express themselves clearly and concisely, presenting acquired learning outcomes;

- argument their opinions,

- adjust to changes in the Croatian legal system due to the accession to the EU;

- develop learning abilities.
