Description:

Administrative Law - exercises - students get familiar with the course of administrative proceedings from its initiation to the adoption of the second-instance decision and its natural continuation in the form of an administrative dispute initiated by an administrative complaint. Students write submissions initiating administrative proceedings, they learn ways of initiating administrative proceedings (ex officio, at the request of a party, public announcement) and on the basis of given facts students learn how to bring the given facts under appropriate legal norm. Students learn to apply the basic principles of administrative procedure and procedure before administrative courts. Students prepare administrative acts (decisions and conclusions) on the rights, obligations and legal interests of the parties, respecting the legal provisions on the components of the decision and conclusion. They learn to lodge an appeal against the first-instance decision and a complaint against the second-instance decision. Judges-practitioners participate in the exercises which encourages collaboration between theory and practice.

Application

After successfully completing the course, students will be able to:

- manage administrative law sources;

- independently apply laws from the area of administrative law (General Administrative Procedure Act, Administrative Disputes Act, Expropriation Act, Croatian Citizenship Act);

- use acquired knowledge for writing administrative acts, appeals, complaint to administrative court;

- illustrate rights which derive from administrative law relation for the parties included (f.e. users of expropriation etc.)

 

Analysis

After successfully completing the course, students will be able to:

- analyse the consequences of illegal administrative action (f.e. annulment, voiding decisions)

- differentiate individual acts that contain discretionary judgment from those in which all parts of the act are strictly connected;

- connect administrative law institutes with individual procedural laws

- solve a concrete problem-oriented task by the application of appropriate legal norm to a factual status;

After successfully mastering the course, students will be able to:

- clearly and precisely exprewss themselves presenting acquired learning outcomes;

- orally present acquired learning outcomes;

- independently prepare an administrative act;

- argument their standpoints on administrative law matters.

- for learning outcomes of analysis, synthesis and evaluation seminar mid-term examinations and practice testing the ability to solve a hypothetical case.
